Terms of Service

1. Agreement to these terms

By creating a Claricito account, downloading the Claricito app, or accessing our website, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Claricito.

These Terms form a legally binding agreement between you and Claricito. "You" refers to you as an individual user. "Claricito," "we," "us," and "our" refer to the company operating the Claricito service.

You must be at least 13 years old to use Claricito (or at least 16 years old if you are in the European Union). By using Claricito, you represent that you meet this age requirement.

2. The Claricito service

Claricito is an emotional intelligence companion platform. It includes:

• Clari, an AI-powered emotional intelligence companion
• Mood logging and emotional reflection tools
• An EQ (Emotional Intelligence) Dashboard
• Personality-based insights and guidance
• Community Circles for connecting with others
• Relationship compatibility insights
• Optional multimodal support features including Scene Check, Facial Emotions, and Ambient Session

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.

3. Claricito is not therapy

4. Your account

4.1 Account creation

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.2 Account security

You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One account per person

Each Claricito account is for one person. You may not share your account with others or create accounts on behalf of others without their consent.

4.4 Account deletion

You may delete your account at any time from within the Claricito app. Account deletion is permanent and will result in the deletion of all your personal data within 30 days, subject to our data retention obligations under applicable law.

5. Subscriptions and payments

5.1 Free trial

Claricito offers a 14-day free trial for new users. No payment information is required to start a free trial. At the end of the trial period, you will need to subscribe to continue using Claricito.

5.2 Subscription plans

Claricito is available on a subscription basis. Current pricing is displayed within the app and on our website. Subscription fees are charged in advance for the period selected (monthly or annual).

5.3 Automatic renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time from within the app or your device's app store settings. Cancellation takes effect at the end of the current billing period — you will retain access to Claricito until that date.

5.4 Refunds

Payments processed through the Apple App Store or Google Play Store are subject to those platforms' refund policies. For payments processed directly through Claricito, we offer a 7-day refund on new subscriptions if you are dissatisfied. Contact us at [email protected] within 7 days of your first payment.

5.5 Price changes

We may change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

6. Your content

6.1 Ownership

You own the content you create within Claricito — your mood entries, reflections, journal text, and other personal content. We do not claim ownership of your personal content.

6.2 Licence to us

By using Claricito, you grant us a limited, non-exclusive licence to process, store, and use your content solely for the purpose of providing the Claricito service to you. We do not use your personal content for advertising, model training, or any purpose beyond delivering your experience.

6.3 Community content

If you share content in Community Circles or other shared areas of Claricito, you grant other users the right to view that content in accordance with the community features. You are responsible for the content you share with the community and should not share personally identifying information you are not comfortable being visible to other users.

6.4 Data export

You may request an export of your personal data at any time by contacting [email protected].

7. Acceptable use

You agree not to use Claricito to:

• Violate any applicable law or regulation.
• Impersonate another person or create a false identity.
• Attempt to gain unauthorised access to Claricito's systems, other users' accounts, or any related infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the Claricito app.
• Use automated scripts, bots, or scrapers to access the service.
• Transmit malware, viruses, or any other harmful or malicious code.
• Use Claricito in any way that could harm, impair, or overburden the service or its infrastructure.
• Use Claricito to harass, abuse, threaten, or harm other users.
• Share content that is hateful, discriminatory, sexually explicit, or that promotes violence.

We reserve the right to suspend or terminate accounts that violate these terms, without notice where the violation is serious.

8. Community standards

Claricito's Community Circles are spaces built on emotional safety and mutual respect. When participating in community features, you agree to:

• Treat other community members with respect and compassion.
• Not share other users' personal information without their consent.
• Not share content that is harmful, exploitative, or designed to manipulate others emotionally.
• Report content that violates these standards using the in-app reporting tools.

We moderate community content and reserve the right to remove content or restrict users who violate these standards.

9. Intellectual property

All intellectual property in the Claricito service — including the app, website, Clari, the six personality type framework, the EQ Dashboard design, the Claricito brand, and all associated content — is owned by or licensed to Claricito.

You are granted a personal, non-exclusive, non-transferable, revocable licence to use the Claricito app for your own personal, non-commercial use. You may not copy, modify, distribute, sell, or sublicense any part of the Claricito service.

10. Third-party services

Claricito integrates with or links to third-party services. We are not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is governed by their own terms and privacy policies.

The Claricito app is distributed through the Apple App Store and Google Play Store. Your use of those platforms is governed by Apple's and Google's respective terms.

11. Disclaimer of warranties

Claricito is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Claricito will be uninterrupted, error-free, or completely secure. We are not responsible for any harm to your device, loss of data, or other damages resulting from your use of Claricito.

12. Limitation of liability

To the fullest extent permitted by applicable law, Claricito's total liability to you for any claims arising from or related to these Terms or the service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

In no event will Claricito be liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Claricito and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of your use of Claricito, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may stop using Claricito and delete your account at any time.

We may suspend or terminate your access to Claricito at any time if we believe you have violated these Terms, if required to do so by law, or if we discontinue the service. Where possible, we will provide notice and an opportunity to remedy the violation before termination.

Upon termination, your right to use Claricito ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and dispute resolution) will survive.

15. Disputes

15.1 Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15.2 Informal resolution

Before filing a formal dispute, we ask that you contact us at [email protected] to describe the issue. We will make a genuine effort to resolve it informally within 30 days.

15.3 Arbitration

If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. The arbitration will take place in Delaware. You and Claricito each waive the right to a jury trial and to participate in a class action.

15.4 Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters relating to intellectual property infringement or misappropriation.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and by posting a prominent notice within the Claricito app at least 14 days before the changes take effect.

Your continued use of Claricito after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using Claricito before the effective date.
